Withdrawal from the contract - ITya.cz

The buyer is entitled to withdraw from the contract without giving a reason within 15 days from the date of receipt of the goods. Only the consumer can exercise this right.

The goods are considered to have been taken over by the buyer at the moment when the buyer or a third party designated by him, except for the carrier, takes over all parts of the ordered goods, or if a) goods ordered by the buyer in one order are delivered separately at the moment of taking over the last delivered ordered item b) delivers goods consisting of several parts or pieces, at the moment of taking over the last part or the last piece, c) delivers the goods repeatedly during a defined period, at the moment of taking over the first delivered goods.

The buyer may withdraw from the contract, the subject of which is the delivery of goods, even before the beginning of the period for withdrawal from the contract.

The buyer may not withdraw from the contract, the subject of which is:

• the sale of goods made to the consumer’s specific requirements, custom-made goods or goods intended specifically for one consumer,

• the sale of goods which are subject to rapid deterioration or change of quality,

• the sale of goods enclosed in protective packaging which cannot be returned for health or hygiene reasons and whose protective packaging has been broken after delivery (for example, lids designed for contact with food),

• selling goods which, due to their nature, may be inextricably mixed with other goods after delivery.

The Buyer may exercise the right to withdraw from the contract in writing or on another permanent medium (eg by e-mail), or by sending a completed form, which is available athttps://itya.sk/odstupenie-od-zmluvy.pdf.

The right to withdraw from the contract can be exercised by sending a notice of withdrawal from the contract on the last day of the 15-day period.

Upon delivery of the notice of withdrawal, the seller shall return to the buyer no later than 15 days all payments received from him under or in connection with the contract, including transport, delivery and postage and other costs and fees. The seller will refund the payment in the same way as the buyer used for his payment. The buyer may agree with the seller on another method of refund.

The seller is not obliged to reimburse the buyer for additional costs if the buyer has explicitly chosen a different delivery method than the cheapest standard method of delivery offered by the seller. Additional costs are the difference between the buyer’s delivery costs and the costs of the cheapest standard delivery offered by the seller.

Upon withdrawal from the contract, the seller is not obliged to return the payment to the buyer before the goods are delivered back or until the buyer proves the return of the goods to the seller unless the seller suggests that he pick up the goods in person or through a person authorized by him.

The buyer is obliged to send the goods back or hand them over to the seller or a person authorized by the seller to take over the goods no later than 15 days from the date of withdrawal from the contract. This time limit shall be deemed to have been kept if the goods were handed over for delivery not later than the last day of the agreed period.

Upon withdrawal from the contract, the buyer bears only the cost of returning the goods to the seller or the person authorized by the seller to take over the goods and also the cost of returning the goods, which due to its nature can not be returned by mail.

The buyer is responsible for reducing the value of the goods, which arose as a result of such handling of the goods, which is beyond the scope of treatment necessary to determine the properties and functionality of the goods.

After delivery of the goods, the buyer can test its functionality but cannot use the goods if he withdraws from the contract. To check the nature, characteristics and functionality of the goods, the consumer should handle and inspect the goods only in the way that would be possible for him in the “regular brick and mortar” shop. The buyer is required to handle and inspect the goods with due care during the withdrawal period.

Goods purchased in the regular stone of ITya s.r.o. cannot be returned. It is only possible to exchange it within 15 calendar days from the date of purchase. The goods must be kept in the same condition in which they were purchased.
